- For the use of this website as well as the business relationships between Omrane - Lashes & More, Grünhaldenstrasse 62, 8052 Zurich and its customers, the following General Terms and Conditions (GTC) apply in the version currently available and valid when you access the website or order goods. The offer on this website is aimed exclusively at customers with Swiss residence. A customer is any natural or legal person who maintains business relationships with Omrane - Lashes & More. The general terms and conditions, the delivery and payment conditions as well as the data protection regulations may be subject to adjustments from time to time. Omrane - Lashes & More asks you to read these provisions carefully each time you visit the website and each time you order goods. These terms and conditions apply exclusively. Conflicting, supplementary or deviating conditions from these General Terms and Conditions require the express written confirmation of Omrane - Lashes & More to be valid. When using this website or ordering goods, the customer confirms that they fully accept these terms and conditions, including delivery and payment conditions. If individual provisions of these General Terms and Conditions prove to be ineffective or unenforceable or become ineffective or unenforceable, the effectiveness of the remaining provisions remains unaffected. - Omrane - Lashes & More 's prices do not include VAT as the company is not subject to VAT. The prices are purely net in Swiss francs (CHF). Any shipping costs will be charged additionally unless otherwise provided and must be paid by the customer. Shipping costs are shown separately in the ordering process. Technical changes, errors and printing errors remain reserved. In particular, Omrane - Lashes & More can make price changes at any time and without prior notice. The sales prices do not include consulting and support services.
- Orders will only be delivered after full payment has been received (exception: delivery against invoice) and provided the goods are available. If, after conclusion of the contract, it emerges that the ordered goods cannot be delivered or cannot be delivered in full, Omrane - Lashes & More is entitled to withdraw from the entire contract or from a part of the contract. If the customer's payment has already been received by Omrane - Lashes & More , the payment will be refunded to the customer. If payment has not yet been made, the customer is released from the obligation to pay. Omrane - Lashes & More is not obliged to provide a replacement delivery in the event of termination of the contract.
- The offers on this website represent a non-binding invitation to the customer to order products and/or services from Omrane - Lashes & More . By ordering via this website, including accepting these terms and conditions, the customer is making a legally binding offer to conclude a contract. Omrane - Lashes & More then sends an automatic “order confirmation” by email, which confirms that the customer's offer has been received by Omrane - Lashes & More . Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal. The contract is concluded as soon as Omrane - Lashes & More sends a declaration of acceptance by email, confirming the dispatch of the ordered products or services.
- Address research If an invoice or reminder cannot be delivered to the recipient address, the customer will be charged a processing fee of CHF 10.00 per address search.
- The invoice is payable within 10 days. Omrane - Lashes & More reserves the right to obtain credit checks about the customer and can forward customer data to third parties for this purpose. In the event of late payment, default interest of 5% per year plus reminder fees of CHF 25.00 will be charged. In the event of default in payment , Omrane - Lashes & More is also entitled to assign the claim to a third party or to instruct it to collect costs, which will incur costs for the customer. The products delivered to the customer remain the property of Omrane - Lashes & More until full payment has been made.
- The payment options specified in the ordering process are available to the customer. Omrane - Lashes & More reserves the right to exclude customers from individual payment options or to insist on payment in advance without giving reasons.
- Deliveries are sent by post or courier to the address specified by the customer in the order. Invoicing is done by email or by post. Upon shipment, the benefit and risk are transferred to the customer, to the extent permitted by law. If the delivery cannot be delivered or the customer refuses to accept the delivery, Omrane - Lashes & More can terminate the contract after notifying the customer of the complaint by email and setting a reasonable deadline and invoice the costs for the work. The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to report any defects for which Omrane - Lashes & More guarantees immediately in writing by letter or email to the address in the imprint. Returns to Omrane - Lashes & More are made at the customer's expense and risk. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to the return address specified by Omrane - Lashes & More in the legal notice. If the inspection by Omrane - Lashes & More shows that the goods have no detectable defects or that they are not covered by the manufacturer's guarantee, Omrane - Lashes & More can charge the customer for the work, the return or any disposal.
- The customer is granted the right of withdrawal for 30 calendar days after receipt of the goods. The deadline is deemed to have been met if the customer sends the written cancellation by email or letter to Omrane - Lashes & More within the deadline. The revocation does not require justification. Exercising the right of withdrawal will result in the contract being reversed. The customer must return the goods within 30 calendar days in their original packaging, complete with all accessories and together with the return slip to the return address specified by Omrane - Lashes & More in the imprint. Returns to Omrane - Lashes & More are made at the customer's expense and risk. Any payment that has already been made will be refunded to the customer within 20 calendar days if Omrane - Lashes & More has already received the goods back or the customer can provide proof of shipping. Omrane - Lashes & More reserves the right to demand appropriate compensation for damage, excessive wear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to invoice it to the customer. When purchasing eyelashes, the right of withdrawal is excluded for hygiene reasons.
- Omrane - Lashes & More strives to deliver goods of impeccable quality. If defects are reported in a timely manner , Omrane - Lashes & More guarantees that the item purchased by the customer is free of defects and functional during the statutory warranty period of usually two years from the delivery date. It is at the discretion of Omrane - Lashes & More to provide the warranty through free repairs, equivalent replacements or a refund of the purchase price. Further claims are excluded. The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects that can be attributed to external circumstances. The warranty for consumable and wear parts (e.g. batteries, accumulators, etc.) is also excluded. It is not possible for Omrane - Lashes & More to provide any assurances or guarantees that the data is up-to-date, complete and correct, or that the website, its functionalities, integrated hyperlinks and other content are constantly or uninterruptedly available. In particular, it is neither guaranteed nor guaranteed that the use of the website will not infringe the rights of third parties who are not owned by Omrane - Lashes & More .
- Omrane - Lashes & More excludes any liability, regardless of the legal basis, as well as claims for damages against Omrane - Lashes & More and any auxiliary persons and vicarious agents. In particular , Omrane - Lashes & More is not liable for indirect damage and consequential damage, loss of profit or other personal injury, property damage and pure financial loss to the customer. Further mandatory legal liability remains reserved, for example for gross negligence or unlawful intent. Omrane - Lashes & More only uses hyperlinks to simplify customer access to other web offerings. Omrane - Lashes & More cannot know the individual content of these websites, nor can we assume liability or other responsibility for the content of these websites.
- Omrane - Lashes & More may process and use the data recorded as part of the conclusion of the contract to fulfill the obligations arising from the purchase contract and use it for marketing purposes. The data necessary to fulfill the service can also be passed on to commissioned service partners (logistics partners) or other third parties.
- Omrane - Lashes & More expressly reserves the right to change these General Terms and Conditions at any time and to bring them into effect without notice. In the event of disputes, only substantive Swiss law applies, excluding conflict of law provisions. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Convention on Contracts for the International Sale of Goods) is explicitly excluded. All legal relationships are subject to Swiss law. The place of jurisdiction is Zurich (ZH), Switzerland
